Digital Millennium Copyright Act (DMCA) Policy
Last Updated: December 13, 2024
This Digital Millennium Copyright Act policy (“Policy”) applies to the RothbardCaucus.com website (“Website”) and any related services provided by the Rothbard Caucus (“Services”). This Policy outlines how we (“Operator,” “we,” “us,” or “our”) address copyright infringement notifications and how you (“you” or “your”) can submit a copyright infringement complaint.
We value the protection of intellectual property and expect our users to do the same. It is our policy to respond promptly to valid copyright infringement claims that comply with the United States Digital Millennium Copyright Act (“DMCA”) of 1998. The DMCA text is available on the U.S. Copyright Office’s website.
Before Submitting a Copyright Complaint
Before submitting a copyright complaint, consider whether the use might qualify as fair use. Under certain circumstances, fair use allows the reproduction of copyrighted material for purposes such as criticism, news reporting, teaching, or research without permission from or payment to the copyright holder.
If you believe your rights have been infringed and fair use does not apply, you may want to attempt to resolve the matter directly with the user before filing a complaint. If you are uncertain about infringement, consider consulting an attorney prior to filing.
Please note that your Notification may be shared with third parties, including the account holder accused of infringement, or publicly disclosed. If you wish to maintain anonymity, you may use an agent to submit your notification.
How to File a Notification of Infringement
If you are a copyright owner or an authorized agent and believe that material available through our Services infringes your copyright(s), you may submit a written copyright infringement notification (“Notification”) in accordance with the DMCA.
All Notifications must meet the requirements of the DMCA. You can use a DMCA takedown notice generator or consult legal resources to ensure compliance. Submitting an accurate, valid, and complete Notification will expedite the resolution process.
Our response may include:
- Removing or restricting access to the allegedly infringing material.
- Terminating repeat infringers’ accounts.
We may require a court order before taking action, depending on the circumstances. If your Notification results in material removal or account termination, we will notify the affected party and provide instructions for filing a counter-notification.
Counter-Notifications
If you receive a copyright infringement Notification, you may submit a counter-notification if you believe the material was removed or restricted due to mistake or misidentification. Counter-notifications must comply with the requirements outlined in the DMCA.
If your counter-notification meets these requirements, we may forward it to the original complainant. If they do not file legal action within a specified timeframe, we may reinstate the material in question.
Changes to This Policy
We reserve the right to update this Policy at any time. Any changes will be effective immediately upon posting unless otherwise stated. We will notify users of significant updates via email or through other appropriate means. Your continued use of our Services after the updated Policy is posted constitutes your acceptance of the changes.
